ORDER ON PLAINTIFFS'
APPLICATION FOR TEMPORARY RESTRAINING ORDER

On July 11, 2000, the Court heard PLAINTIFFS, MONETIZEMEDIA.COM, INC., DANNY MICHAEL BEAVERS, DONALD MARK BEAVERS, ROBERT W. THOMAS, JR, & ROY W. WIESNER, application for temporary restraining order.

1. The Court, after notice to the defendants, by examining the pleadings and affidavits, and conducting a hearing in which all parties were represented either in person or by telephone finds there is evidence that:

a. Harm is imminent to plaintiffs, and if the Court does not issue the temporary restraining order, plaintiff will be irreparably injured because its legitimate business operations cannot be continued without access to and the use of its own property, and the examination and dissemination of its proprietary and trade secret technology will destroy the economic value of that property.

Therefore, the Court:

    A. Restrains defendants, John Cornyn, Attorney General of Texas, Sergeant Investigator Stephen Acker, and Assistant Attorney General David Puryear, and all of their agents from:

      1. Any further search of or examination of any hard copy documents or computer stored documents seized from the plaintiffs pursuant to any search warrants executed on or about June 26, 2000, in any location in Texas. The Attorney General and his agents are, as discussed during the hearing, permitted to download all computer hard drives and copy whatever material it deems material to its ongoing investigation.

      2. Any further detention of the computers, printers, routers. or other computer equipment business equipment or the originals of Monetizemedia.com's corporate documents, accounting ledgers, and blank checks, after 2:00 p.m. Friday, July 14, 2000, unless this Court has authorized further detention before that time because of extraordinary hardship by the Attorney General's Office in copying the material on the hard drives of the computers and/or other documents.

    B. Orders the clerk to issue notice to defendants. John Cornyn, Attorney General of Texas, Sergeant Investigator Stephen Acker, and Assistant Attorney General David Puryear, that a hearing on plaintiffs' application for temporary injunction Is set for July 18, 2000 at 10:00 a.m. The purpose of the hearing shall be to determine whether this temporary restraining order should be made a temporary injunction pending a full trial on the merits.

    C.The bond is set at $10,000.

This Order expires on July 27, 2000.
