The Interactive Media Entertainment & Gaming Association (iMEGA) today filed in U.S. Circuit Court 3rd District in New Jersey a brief asking the court to the press for a temporary restraining order (TRO) ahead of schedule.
iMEGA on June 5 filed a lawsuit seeking a TRO against the United States from enforcing the Unlawful Internet Gambling Enforcement Act (UIGEA), alleging the law is unconstitutional on several counts. The defendants, the Department of Justice, the Federal Reserve Board and the Federal Trade Commission would normally be given 60 days to respond to the allegations, but iMEGA hopes that the brief would grant them an expedited hearing.
"We hope this will accelerate the timeline for a hearing in front of Judge Cooper, and prevent the defendants from sandbagging so that the regulations can be promulgated in the interim," said Joe Brennan Jr., iMEGA founder.
Today is the deadline for the Federal Reserve Board and the U.S. Treasury Department to publish the regulations as prescribed by the UIGEA. A spokesperson from the Federal Reserve Board said today that the department is working with the Treasury to get a proposal out soon.
