Section 1. Section 725.7, Code 2001, is amended by adding the following new subsection:
NEW SUBSECTION. 1A. Except as authorized in chapters 99B, 99D, and 99E, a person shall not use the internet to conduct or participate in a lottery or to do any act prohibited under subsection 1.
EXPLANATION
This bill prohibits a person from using the internet to conduct or participate in a lottery or in a game for any sum of money or property, to make a bet, to engage in bookmaking, or to deliver a wager for a fee. There are four degrees or levels of penalties for engaging in illegal gaming, ranging from a serious misdemeanor for a first offense if the sum of money or the value of property involved is less than $100, to a class "C" felony if the sum of money or value of property involved exceeds $5,000. A serious misdemeanor is punishable by a fine of at least $250 but not more than $1,500 and the court may order imprisonment not to exceed one year. A class "C" felony is punishable by imprisonment for no more than 10 years and, in addition, the court may impose a fine of at least $500 but not more than $10,000.
