Judge Declares IGT Wheel Patents Invalid

Bally Technologies Inc. announced today that a Federal District Court in Nevada has issued written orders granting Bally’s motion for a summary judgment in a key patent case between Bally and International Game Technology.

According to the prepared statement from Bally, the court ordered IGT’s two “wheel” patents invalid as well as its touch-screen player-tracking patent. Additionally, the statement said that Bally games and its SDS and SCSC iView player-tracking units do not infringe on neither IGT’s wheel-related patents and the two asserted player-tracking patents.

"The Court's rulings validate Bally's approach to intellectual property and minimize any potential financial exposure for the Company," said Richard M. Haddrill, Bally’s chief executive, in a prepared statement. "These rulings strengthen Bally's antitrust case against IGT and leave it as the only significant matter remaining in the case."

The statement went on to say that the court ordered that Bally's antitrust counterclaims may proceed to trial.
