It's a long shot, but indicted BetonSports founder Gary Kaplan could be released from jail while he awaits trial.
U.S. District Judge Carol Jackson on Monday granted Kaplan a hearing on his motion for release from pretrial detention.
Kaplan has been deemed an enormous flight risk and has been held in custody since his arrest in March.
Kaplan's attorneys on June 29 filed a motion arguing that Magistrate Judge Mary Ann Medler failed to consider alternatives to incarceration and conditions of release that would assure Kaplan's appearance at trial.
Following a series of letters between Kaplan's attorney and the prosecuting attorney and second motion requesting a hearing on the matter, Kaplan has been granted at least that.
According to court documents, Kaplan has proposed a new set of release conditions that will assure his appearance at trial.
The hearing is set for Aug. 31 at 10:30 a.m.
