Tropical Paradise Enterprises, the Costa Rican operator of paradisepoker.com that filed a lawsuit against Discovery Communications Inc. to regain $3.25 million from a canceled advertising contract, today filed a notice of dismissal without prejudice with the court, thereby dropping its case.
It is important to note that by entering the notice "without prejudice," Tropical Paradise retains the right to bring the case to court again. (This would not be the case if it had entered "with prejudice.")
Making the case even stranger is the fact that Discovery failed to answer the complaint by the June 11 deadline. It's possible that the two parties reached an agreement whereby the complaint would not be necessary because Tropical Paradise would be dropping the case anyway.
Tropical Paradise and its legal team were not available for comment at the time of this posting.
