US Files Motion to Dismiss in iMEGA Case

The case between the Interactive Media Entertainment & Gaming Association (iMEGA) and the U.S. Justice Department (DOJ) has been postponed yet again, as DOJ has filed a motion to dismiss the suit on grounds that it lacks substance.

iMEGA on June 5 filed a complaint against seeking a temporary restraining order against DOJ, the Federal Trade Commission (FTC) and the Federal Reserve Board of Governors to prevent them from issuing regulations for the U.S. Unlawful Internet Gambling Enforcement Act (UIGEA).

But on Aug. 21 DOJ filed a cross-motion to dismiss the case for lack of jurisdiction and because it fails to state a claim on which relief may be granted.

Both parties have agreed to a hearing on Sept. 26 in a New Jersey federal court.
