URU Addresses One of the Industry's Biggest Needs

Online gambling companies are enlisting the help of the GB Group, a U.K.-based data services company, to help fortify the fight against Internet fraud and underage gambling. The company in November launched a portal (www.uru.co.uk) offering the latest news and advice on combating identity fraud and money laundering; it also serves as a promotional tool for the group's URU identification verification service.

Internet Gaming: The Role of the Dormant Commerce Clause

In the United States, 48 of the 50 states allow some form of legalized gaming. Many of these 48 states, however, have laws in place that limit the ability of their citizens to make wagers with out-of-state providers of gaming. The increase of Internet gaming sites is putting these laws in the spotlight. One rationale in support of these laws is the protection of the economic interests of in-state providers, often the state itself in those states that operate state lotteries. Perhaps because states have general police power to regulate in areas of "legitimate local concern," there have been no legal challenges specifically aimed at the state laws that discriminate against out-of-state gaming providers. But, this may change in light of U.S. Supreme Court's recent decision in
Granholm v. Heald
.

Cherry Split in the Works

The Board of Swedish gambling firm Cherryforetagen AB (CHERb.ST) will propose a plan at its general meeting in the first quarter of 2006 to split the company into three independently listed companies. The three distinct divisions--Cherry Online, Net Entertainment and Cherry Casino--are already independent operations with limited benefits from collaboration, but the board feels that the three branches could be developed more rapidly and stronger on their own. A split would also provide better transparency of the different businesses and allow shareholders to choose their desired risk level and area of operations.

Implications of the Dutch Breda Ruling

The Netherlands Administrative Court of Breda rendered a monumental decision on Dec. 2 in a case that could have a tremendous impact on future gambling-related court rulings and policy decisions in the country. The court ruled that the defendants of the case--the Dutch Minister of Justice and Dutch Minister of Economic Affairs--failed to prove that the country's state-run monopoly system for casino gaming is consistent and coherent in attaining its intended goals and therefore restricts freedom of services in an illegal way.
