On June 2nd PartyGaming plc, the world’s biggest online poker company, said it would offer up to 23% of its shares in an initial public offering (IPO) on the London Stock Exchange. The issue was tentatively priced on June 15th at 111 pence to 127 pence; the mid point of this range would value the company at £4.76 billion. Earlier estimates were higher. In early June CNN News put the deal’s size at about $1.8 billion, valuing PartyGaming at $7.8 billion; some analysts said PartyGaming would be worth $8 billion to $10 billion, or £4.4 billion to £5.5 billion.

A Closer Look at Casino City's Appea

Casino City's primary goal in appealing its declaratory judgment case to the U.S. Court of Appeals for the Fifth Circuit is to obtain a ruling that the company does indeed present a First Amendment Issue. In February 2005 the Casino City case was dismissed by the Department of Justice at the district court level because the court declared that the company failed to present a case or controversy and that it does not have standing to present the case. The district court dismissed the case without even granting Casino City a hearing. The company's recent appeal charges that the district court's decision is erroneous, and although the arguments presented to the Court of Appeals are quite similar to those presented to the district court, they are now reinforced by a myriad of case law examples in which plaintiffs were objectively chilled from exercising free speech but were found to have standing.

PartyGaming Float Still On Schedule

On June 15th Gibraltar-based PartyGaming published its 200-page flotation prospectus, which among other things revealed that the company would seek a market valuation between $8 billion and 9.2 billion (£4.4 billion and £5.1 billion). The valuation is significantly lower than the $10.5 billion (£5.8 billion) figure that the company originally indicated it would seek only a couple weeks ago. The company's prospectus declares the new valuation a "realistic assessment" of the company's worth, but many news analysts have speculated that the decrease in value is a response to investors' concerns. Chief among those concerns is how the company, which derives close to 90 percent of its business from the US, will cope with the legal uncertainty of online gambling in the US.
