Online Gaming in Wisconsin

In November 2017, a pair of bills – SB 436 and AB 526 – were introduced, seeking to regulate DFS within the state. Wisconsin law follows a "predominance test" in which the relative levels of skill and chance are measured to determine if the contest is permissible.

Daily fantasy sports are neither legal, nor illegal, as a result, there are multiple DFS sites accepting players from the state. As of mid-2026, Wisconsin has not enacted a comprehensive DFS statute, so paid fantasy contests operate in a largely unregulated environment, relying on the state’s skill-versus-chance interpretation and the absence of specific prohibitions.

Beyond DFS, Wisconsin has not legalized online casino games or real-money online poker; internet gambling outside tribal-regulated sports betting apps is generally treated as unlawful.
