ATR and UK Racing Settle Media Rights Case; Industries Look to Future

A High Court dispute between Britain's two dedicated horse racing television channels ended last week when At The Races agreed to accept £1 million to settle its complaint against Racing UK. At The Races had actually sought a sum of £55 million from the 30 race courses that now constitute Racing UK after the courses bailed out of the first failed At The Races venture, but the case had not proceeded as At the Races had planned and Racing UK had launched a counter-claim against At The Races for £200 million. Racing UK has dropped its counter-claim as part of the agreement, and there is now expectation that the two companies might eventually cooperate on a project to market British racing to the rest of the world.

Nevada Gaming Commission Solidifies Mobile Handheld Gaming Device Rules

Last Thursday the Nevada Gaming Commission (NGC) passed regulations set forth by the June 2005 passage of Assembly Bill 471, which authorizes the use of mobile communication devices for gaming in Nevada casinos, making Nevada the first state in the U.S. to allow mobile gaming.

German Sportsbetting: Back to the Stone Age

The verdict in the German State monopoly case on sports betting has created one big legal turmoil, and it reminds me of the Gambelli case. There also the two main interest groups (European Lotteries/State monopolies and the rivaling crossborder online operators/EBA&RGA) both proclaimed victory. This 24-page verdict of the Bundesverfassungsgericht, the German constitutional court, is like déjà vu. I have seen it before where every interest group felt it was the winner. However, the real winners are the lawyers because the verdict is certain to lead to even more court cases.

Could PBL Bid Forge Alliance Between Victoria Racing and Betfair?

Australian media and gambling conglomerate Publishing and Broadcasting Limited (PBL) has proposed a A$25 million bid to acquire a 25 percent stake in ThoroughVisioN (TVN), the Australian horse racing broadcaster that is jointly owned by six of the country's racing clubs. Acceptance of the offer would provide TVN with relief from mammoth start-up expenses and costs of waging a war its Tabcorp-owned rival Sky Channel. The fact that PBL is engaged in a joint venture partnership with Betfair makes the prospective deal even more intriguing. The race clubs, especially the ones in Victoria, vehemently opposed the licensing of Betfair's betting exchange in Tasmania last year, but ironically it is Betfair that could serve as the vehicle that would allow TVN to bid on the 2012 Victorian wagering license if the deal with PBL is accepted.

WTO Deadline for U.S. Only Days Away

The United States' deadline to implement a ruling by the Dispute Settlement Body of the World Trade Organization is Monday, April 3, but the country has taken no observable actions towards conforming to the ruling. It can safely be assumed that on Monday neither the U.S.' opponent in the dispute-- the tiny island nation of Antigua and Barbuda—nor the Dispute Settlement Body will be satisfied with the U.S.' status report. The absence of action on behalf of the U.S. not only casts doubt on whether Antigua can reap any sort of reward from its victory, but on a larger scale it also seriously jeopardizes the integrity of an international body that is meant to provide a fair venue for disputes between countries both big and small.
