EC, Netherlands Clash on Gambling Policy

European Commission Vice President Gunter Verheugen recently sent a letter to the Dutch government concerning its plan to award Holland Casino a three-year license to exclusively operate games of chance over the Internet. Verheugen's letter warns the Netherlands against proceeding with its proposed monopoly scheme for online games of chance, advising that such a policy would not be compatible European Laws that establish the freedom to provide services in other member states.

The next big sign of consolidation in the I-gaming industry could be the acquisition of Ongame e-solutions AB—the Sweden-based developer of online gaming technology and operator of PokerRoom.com—by Austria-based betting and gaming operator Betandwin.com Interactive Entertainment AG. The two companies have entered into a Memorandum of Understanding, and discussions are currently in a preliminary phase, with neither firm wishing to disclose an asking price to the public.

Academic Study Could Shape EC Gambling Policy

The Swiss Institute of Comparative Law (SICL) is currently undertaking a study of gambling services in Europe that could soon become an important factor in shaping how the European Commission (EC) approaches cross border gambling. The study entails an in-depth analysis of the economics of gambling in the European internal market as well as an analysis of all the existing laws and regulations that govern gambling. A draft report is tentatively scheduled for release in the Spring of 2006.

Court Rules Against Dutch Casino Monopoly; EC Admonishes Proposed I-gaming Monopoly

In a main proceedings judgement of last Friday (2 December 2005) the Administrative Court of Breda rendered a landmark post-Gambelli judgement in the proceedings between the Compagnie Financière Régionale B.V. (hereinafter : “CFR”) against The Ministry of Justice and the Ministry of Economic Affairs (hereinafter: “the State”). The decision of the Breda Court can be qualified as no less than a historic victory for the supporters of the principles enshrined in the Treaty of Rome, notably articles 43 and 49 of the Treaty. After various Dutch interlocutory Courts and one main proceedings Court found the Dutch gaming legislation and policies to be compliant with the so-called Gambelli criteria in several cross-border internet gambling cases , the Breda Court ruled that the State monopoly on (casino) gambling is not effective and there is no specific evidence to substantiate that the restrictive casino legislation is coherent and consistent....

A collaborative research project from three groups that have closely monitored social issues related to Internet gambling revealed in July 2004 that the age verification systems from an alarmingly high percentage of online gambling operators were perhaps not up to par. The study--conducted by children's charity organization NCH, GamCare, which addresses the social impact of gambling, and ID authenticity specialist Citizencard--was an eye opener for many in the I-gaming space, especially considering the prominence and stature of some of the operators that failed the test. Seventeen months later, IGN has taken a firsthand look at how the problem is being addressed.
